Bridge McFarland LLP has secured £125,000 in damages for the family of a former Grimsby and Immingham Docker who died from Asbestosis.
The deceased was diagnosed with Asbestosis after undergoing a routine CT scan at Grimsby Hospital. He was regularly exposed to asbestos in the 1960’s and 1970’s whilst working on the Grimsby and Immingham Docks unloading bags of asbestos dust which were imported before being distributed elsewhere. The bags would regularly split during the unloading process which covered the deceased and his work colleagues in clouds of dangerous asbestos dust. The deceased was never warned about the dangers of working with asbestos or provided with suitable breathing protection.
Partner James Burrell, an Industrial Disease Specialist, said “this was a very complicated case requiring specialist medical advice and multiple parties were involved to bring the matter to a successful conclusion. This was a very difficult case in terms of proving that the deceased died from an asbestos related medical condition. The whole case and particularly the inquest process was very difficult for the family. We hope that the family see this settlement as achieving some justice for their late father and allow them to move forwards.”
A family representative said, “we were quite shocked when he received an Asbestosis diagnosis and distraught when he died sometime later. The condition affected him and his independence greatly.
