Who Can Make a Claim

Anyone diagnosed with an asbestos-related disease, such as mesothelioma, asbestosis, pleural thickening or asbestos-related lung cancer, may be able to claim compensation.

In most cases, people diagnosed with an asbestos-related disease have done so as a result of occupational exposure. However, it is not unheard of for partners and children for those in industrial employment to also have been diagnosed with an asbestos-related disease due to exposure from fibres on their loved ones’ clothes. In addition, we have also seen cases of other professionals, such as teachers and MPs, who have been exposed whilst at work.

For anyone diagnosed with an asbestos-related disease, promptly enquiring about making a compensation claim is essential.

Can I make a claim?

No matter the circumstances in which you were exposed to asbestos, you may be able to make a claim.

At Asbestos Awareness, we typically see claims arise from people in the following industries. However, we have also seen claims from others:

How long do I have to make a claim?

Making a claim following a diagnosis of an asbestos-related disease can be greatly beneficial in bringing some closure to the victim and their family in getting the illness recognised. In addition, the receival of financial compensation and/or ongoing government benefits can significantly improve their financial situation.

However, for most victims of asbestos-related diseases, there is a time limit that dictates how long after their diagnosis they have to make a claim.

For most asbestos-related disease claims, the limitation period commences on the date that you were first diagnosed. Typically, the limitation period is three years. Therefore, if you or your family member has been diagnosed with an asbestos-related disease such as asbestosis, pleural thickening, mesothelioma or asbestos-related lung cancer, you must make a claim before the three-year period ends. In a case of death from asbestos exposure, the time limit is normally three years from date of death.

If your loved one dies during the process of making a compensation claim, it is possible to pick up the claim on their behalf and obtain the compensation they deserve. Learn more about making a compensation claim on behalf of a family member here.
